Automotive Deposits, Project Payments & Cancellation Policy

This section applies to repair, restoration, performance, fabrication, modification, diagnostic, body, paint, engine, transmission, electrical, tuning, and other vehicle work performed by Smothers Supercars.

Specific written estimates, work authorizations, invoices, or project agreements may contain additional or different terms.

Project Scheduling Deposit

Unless a different arrangement is agreed to in writing, Smothers Supercars may require a deposit equal to approximately 10% of the anticipated project amount to reserve a place in the production schedule.

The scheduling deposit will be credited toward the customer’s project balance.

Payment of a scheduling deposit does not guarantee an exact completion date.

Any portion of a scheduling deposit that is specifically designated as a non-refundable reservation or scheduling fee will be clearly disclosed to the customer in writing before payment.

Vehicle Drop-Off Deposit

Unless otherwise agreed in writing, an additional deposit equal to approximately 20% of the anticipated project amount may be required when the vehicle is delivered to Smothers Supercars.

Deposited funds may be used toward authorized project expenses, including:

  • Labor
  • Parts
  • Materials and supplies
  • Freight
  • Subcontracted services
  • Outside machine work
  • Applicable taxes and fees
  • Other authorized project expenses

Ongoing Project Funding

Large restoration and performance projects may require ongoing funding as work progresses.

Smothers Supercars may maintain a customer-funded project balance from which approved labor, parts, materials, and other project expenses are charged.

When available project funds approach approximately $1,000, Smothers Supercars may request an additional payment before continuing work or ordering additional parts.

Work may be temporarily paused until required project funding is received.

Pausing a project for lack of funding may affect scheduling and completion estimates.

Estimates

Automotive estimates are based on the information reasonably available at the time they are prepared.

Restoration, repair, fabrication, body, paint, mechanical, and performance work can uncover hidden conditions after work begins.

Examples may include:

  • Hidden rust or corrosion
  • Previous collision damage
  • Poor previous repairs
  • Wiring damage
  • Missing or incorrect parts
  • Internal engine or transmission damage
  • Structural problems
  • Parts compatibility issues
  • Previously modified components
  • Conditions that cannot reasonably be identified before disassembly

Unless specifically identified as a guaranteed fixed price in writing, an estimate is not a guarantee of the final project cost.

Additional Work and Changes in Scope

If additional work is recommended or the customer requests changes to the original project, Smothers Supercars may provide an updated estimate, authorization request, invoice, or other written communication.

Customer authorization may be documented through a signed document, email, text message, electronic approval, or another method reasonably showing approval.

Significant changes may affect cost and completion timing.

Parts

Smothers Supercars may order parts and materials reasonably necessary for authorized work.

Special-order, custom-made, modified, painted, machined, discontinued, electrical, or otherwise non-returnable parts may not be refundable after they have been ordered when the supplier does not permit their return.

Restocking fees, return freight, cancellation charges, and other supplier charges associated with customer-requested cancellations may be charged to the project when applicable.

Customer-Supplied Parts

Smothers Supercars may decline to install customer-supplied parts.

If customer-supplied parts are accepted, Smothers Supercars does not guarantee the quality, compatibility, condition, or manufacturer warranty of those parts unless specifically agreed otherwise in writing.

Additional labor caused by incorrect, defective, missing, or incompatible customer-supplied parts may result in additional charges.

Project Cancellation Before Work Begins

A customer who wishes to cancel a scheduled project should notify Smothers Supercars in writing as soon as possible.

If a project is canceled before work begins, Smothers Supercars will reconcile the customer’s account.

Amounts already committed to special-order parts, non-refundable supplier charges, authorized preliminary work, transportation, administrative expenses specifically agreed to by the customer, or any separately disclosed reservation fee may be deducted where applicable.

Any remaining refundable customer funds will be returned after the account has been reconciled.

Project Cancellation After Work Begins

If a customer cancels a project after work has begun, the customer remains responsible for authorized:

  • Labor already performed
  • Diagnostic or disassembly work
  • Parts and materials
  • Special-order items
  • Subcontracted work
  • Freight
  • Applicable taxes
  • Other project expenses already incurred

Smothers Supercars will prepare a final accounting of the project.

Any refundable customer funds remaining after all applicable charges have been satisfied will be returned to the customer.

Project Delays

Completion dates for restoration, fabrication, mechanical, body, paint, and performance projects are estimates unless Smothers Supercars expressly guarantees a date in writing.

Projects may be delayed by circumstances including:

  • Hidden vehicle conditions
  • Parts availability
  • Backordered components
  • Supplier delays
  • Machine-shop or subcontractor delays
  • Additional customer-requested work
  • Changes in project scope
  • Customer approval delays
  • Funding delays
  • Unforeseen technical problems

Smothers Supercars will make reasonable efforts to communicate material changes affecting the project.

Vehicle Pickup and Final Payment

Unless otherwise agreed in writing, all amounts due for completed work must be paid before the vehicle is released.

Smothers Supercars reserves any rights or remedies provided by applicable Oklahoma law regarding unpaid labor, parts, materials, storage, or other authorized charges.

Storage

Vehicles should be picked up within the timeframe communicated by Smothers Supercars after the customer is notified that the vehicle is ready.

If storage charges may apply to a vehicle that is not picked up, the applicable storage terms or rates will be disclosed through the estimate, invoice, work authorization, posted shop policy, or other written notice as appropriate.

Performance Vehicles

Performance modifications can increase stress on engines, transmissions, drivetrains, suspension systems, tires, brakes, and other components.

Unless expressly guaranteed in writing, Smothers Supercars does not guarantee a particular:

  • Horsepower level
  • Torque figure
  • Quarter-mile time
  • Elapsed time
  • Trap speed
  • Fuel economy figure
  • Vehicle lifespan
  • Competition result

Any stated performance target is dependent on the complete vehicle combination, operating conditions, driver, fuel, tires, track conditions, maintenance, and other factors.

Racing and Competition Use

Motorsports and competitive driving involve inherent risks.

The customer is responsible for operating the vehicle safely and complying with applicable laws, track rules, sanctioning-body requirements, insurance requirements, and safety requirements.

Warranties

Any warranty applicable to Smothers Supercars labor or workmanship will be stated in the applicable invoice, project agreement, or other written warranty terms.

Third-party parts may be covered by a manufacturer’s or supplier’s warranty rather than a Smothers Supercars warranty.

Normal wear, racing use, abuse, improper maintenance, overheating, misuse, unrelated component failure, or modifications performed by others may affect warranty coverage where permitted by law.

Relationship to Other Agreements

This Automotive Project Policy is intended to supplement individual estimates, invoices, work authorizations, and project agreements.

When a customer’s signed project agreement contains more specific terms concerning the same subject, the signed agreement will control to the extent permitted by law.
